Do Not Appeal to the Human Rights Code for an Exemption from a Vaccine Mandate
Here is an example of invoking your right to religion and conscience using the Canadian Charter of Rights and Freedoms
They are tricking you - the human rights code of Manitoba does not protect you from a vaccine mandate. Here is an example of invoking your right to religion and conscience using the Canadian Charter of Rights and Freedoms. Let me know if you have any comments or suggestions for changes. Disclaimer: We are not lawyers, we are citizens that aim to use the laws to defend our freedoms.
I am invoking my right to religion and conscience, under the Charter of Rights and Freedoms Section 2(a) freedom of conscience and religion. As a Christian I am instructed by Scripture to view my body as a temple of the Holy Spirit and to steward my body accordingly as a creature ultimately accountable to God (Rom. 12:1: 1 Cor. 3:17-20, 6:19-20, 7:1).
God created my body, and I believe if I take care of my body, I will have good health and will be able to fight any pathogen, God-willing. I believe it is a sacrilege to introduce into the body living organisms or any unnatural matter that may alter the natural balance of my body.
Christians recognize that they will one day stand before God to give an account for their lives and do therefore seek to exercise wisdom and discernment in all their decisions (2 Cor. 5:10; Rom. 12:2).
As steward of my body, I cannot abdicate any decision about what I do to my body to anyone else. As a steward I have taken personal responsibility to learn as much as I can about the proposed vaccines. I am concerned that the investigative status of the vaccines leaves many questions unanswered as to the safety of the composition of the vaccines for my body. Given I lack complete information about this product and how my body will assimilate it, I will refrain from taking it. There is no way to provide informed consent without complete information that longterm studies would provide. As an example, I have reviewed the product monograph of the COVID-19 vaccines to learn that there are no human studies on reproduction and fertility.[1],[2],[3],[4] In the product monographs for Canada (links provided in footnotes) you can see that the manufacturers, of the four vaccines authorized in Canada, make no claims of knowing about reproductive or fertility effects in humans because there are NO human studies. There is a study listed in the licensure of Pfizer’s Comirnaty on long-term pregnancy outcomes that will end in 2025[1], but otherwise no fertility or reproductivity studies are listed. The trials are ongoing, data collection has begun, yet, healthcare providers and others in the public have been led to believe these vaccines do not affect reproduction or fertility. In fact, the product monograph for all four vaccines authorized in Canada indicate that the “safety and efficacy” of the vaccine “in pregnant women has not been established” and that there are “no human studies” on fertility or reproduction.

I ascribe to the Christian declaration of the Liberty Coalition found here: https://www.libertycoalitioncanada.com/religious-freedom-from-vaccination-coercion It is signed by 12 pastors whom I consider my religious leaders.
The Charter of Rights and Freedoms is the highest law in Canada as declared in Section 52(1) of the Constitution Act, 1982 – The supremacy clause The Constitution of Canada is the supreme law of Canada, and any law that is inconsistent with the provisions of the Constitution is, to the extent of the inconsistency, of no force or effect. https://www.justice.gc.ca/eng/csj-sjc/rfc-dlc/ccrf-ccdl/check/art521.html
According to honorable Brian Peckford, former Premier of Newfoundland and the last living signatory of the Charter, Section 1 of the Charter says that Charter rights can be limited by law, he has signed an affidavit to establish that COVID-19 pandemic does not satisfy the 4 conditions for limiting rights: (1) the override must be demonstrably justified; (2) must be done by law; (3) must be within reasonable limits; (4) all has to be consistent with the values of a free and democratic society. None of these conditions are satisfied by the COVID-19 vaccine mandate in this pandemic. It is your responsibility to prove that the conditions are met. You can see Brian Peckford explain he is signing affidavit’s for court proceedings in this video: https://tinyurl.com/brianpeckford
Further under Section 97 of the Public Health Act of Manitoba, I am exercising my right to opt out of the vaccine mandate.
No treatment or immunization if person objects – Despite any other provision of this Act, no person is required to comply with an order made under this Act requiring him or her to receive treatment or be immunized, if the person objects to the treatment or immunization. https://web2.gov.mb.ca/laws/statutes/ccsm/p210e.php
Finally, under Section 7 of the Canadian Charter of Rights and Freedoms: Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice. If there is a ubiquitous mandate, how can I work and earn a living while preserving my right to religion and conscience?
